Law 21.719 — future regime from 1 December 2026

Law 21.719 — effective 1 December 2026

Law 21.719 modernises Law 19.628 and creates an independent Data Protection Agency. Its obligations are mapped as future-readiness controls until commencement.

The incoming regime adds structured data-subject procedures, portability, automated-decision safeguards, lawful-basis documentation, transparency, privacy by design and default, risk-based security, breach reporting, processor contracts, impact assessments, transfer rules and an enhanced accountability and enforcement framework.

Not yet operative

As of 25 August 2026, these controls are preparation items. They become legal requirements on 1 December 2026.
